You or someone you love may have been injured physically, financially, or in any other way, because of someone else’s actions. You may have a basis for a personal injury claim if that’s the case. Personal injury cases arise when someone is harmed due to carelessness or misconduct.

Generally speaking, if the negligent, reckless or intentional behavior of an individual causes injury to someone else, the grounds for a personal injury suit may exist. Let’s now look at some major types of personal injury cases.

Premises Liability

Premises liability refers to injury claims arising from unsafe conditions on someone else’s property. Slips and falls due to wet floors, unmarked steps, poor lighting, or other hazards are common premises liability cases.

Inadequate security resulting in assault, insufficient fencing around a pool leading to drowning, and dog bites on the property also fall under this category. Just a few examples of potentially liable parties include shop owners, restaurants, hotels, apartment complexes, and homeowners.

Medical Malpractice

If a medical practitioner like a doctor or nurse fails to meet accepted standards of care, and a patient suffers harm as a result, the grounds exist for a medical malpractice claim. Frequent malpractice cases often involve misdiagnosis, surgical mistakes, medication errors, childbirth injuries, and anesthesia accidents.

To succeed in a malpractice case, the plaintiff must prove negligence directly led to their injury or worsened their condition. Expert testimony is usually required to establish proper protocols were not followed. Awards can include coverage of corrective procedures, rehabilitation, lost wages, and pain and suffering.

Motor Vehicle Accidents

There are plenty of cars on our roads and as such, accidents are bound to happen regularly. Depending on factors like speed and use of safety devices, injuries resulting from auto accidents can be severe or catastrophic sadly. With the help of a lawyer, you can claim damages for such things as medical bills, lost income, or permanent disability care.

Workplace Accidents

Injuries that happen on the job may warrant a personal injury claim against the employer. Common causes include lack of training on operating equipment, failure to provide protective gear, absence of posted warnings about hazards, and ignoring employee complaints about safety concerns.

Construction sites, industrial facilities, and other high-risk workplaces tend to generate more accidental injury claims. However, even office settings can be liable if someone slips on a wet floor or falls down steps. Employers are responsible for providing a safe work environment.

Defective Products

When a defective product malfunctions or contains a design flaw causing injury to a consumer, the manufacturer, distributor, or retailer can be held responsible through a product liability claim. Some examples include a faulty airbag failing to deploy, a medication with harmful side effects, or a recalled children’s toy containing lead paint.

The key is proving the product had an unreasonably dangerous defect and that this defect directly led to the consumer’s financial, physical, or emotional damages. Companies responsible for releasing defective products must compensate victims harmed by their oversight or negligence.
